This notice is intended to provide information about the legal requirements that we as a company must observe if we are asked for information by law enforcement authorities or government agencies. Compliance with these requirements is crucial for the protection of our customers' privacy and rights.
Legal basis for inquiries
Police requests for information must be based on a clear and valid legal basis. This basis is anchored in the relevant laws and regulations of the country or region and regulates why and how such requests may be made. As a company, we are obliged to ensure that all requests we receive have the required legal basis.
We therefore check whether a relevant legal basis is stated on the basis of which we are obliged to disclose the specific data. We also check whether the legal basis is lawful.
Proportionality
The requirements in police requests for information must be proportionate, i.e. they must be proportionate to the seriousness of the offense or the need to investigate. We must ensure that the information requested does not unduly violate the privacy of our customers.
We check whether the purpose of the request for information is clearly and unambiguously stated and whether the specific data requested is necessary for this purpose.
Informing the persons concerned
In accordance with Article 13(3) of the General Data Protection Regulation, we are obliged to inform customers whose data is affected by a police request for information. This gives them the opportunity to protect their rights and, if necessary, to lodge an objection. It may be necessary to refrain from informing the data subjects in order not to jeopardize the investigation. We take our obligation to comply with the General Data Protection Regulation seriously and take the necessary measures to protect the privacy and rights of data subjects.
We therefore check whether it is necessary to refrain from notifying the data subjects, e.g. in order not to jeopardize investigations (required under Art. 13 (3) GDPR).
