Jimdo – Terms of Service for Google Ads via the Jimdo Dashboard

    Art. 1 - General

    (1) The following terms of service for the use of Google Ads via the Jimdo Dashboard (hereinafter "Jimdo Google Ads Terms of Service") shall apply to the extent that the Customer activates Google Ads via the Jimdo Dashboard. 

    (2) The Google Ads service lets you create, manage, buy and optimize your ads on Google Ads from your Jimdo account. From your dashboard, you can create targeted campaigns, define audiences and much more. 

    (3) Google Ads is operated and provided by Google Ireland Ltd, 4 Barrow St, Grand Canal Dock, Dublin 4, D04 V4X7, Ireland. Jimdo provides the technical integration in the Jimdo dashboard of the Customer account. Jimdo, Google and the Customer are independent contractual partners with regard to the Google Ads service.

    Art. 2 - Requirements and obligations of the Customers

    (1) Consumers are excluded from using the Google Ads integration via Jimdo Dashboard. The use of Google Ads Services via the Jimdo Dashboard is reserved solely for business customers.

    (2) The Customer may only use Google Ads via the integration in the dashboard if the Customer agrees to the following terms and conditions of Google and does not violate these or any other applicable laws and regulations during the term of the contract:

    (3) The confirmation of these terms and conditions set forth in Art. 2 (2) Jimdo Google Ads Terms of Service shall take place upon the Customer's first registration with Google Ads via the Jimdo Dashboard by explicitly pointing this out to the Customers. The terms and conditions of Google referred to in Art. 2 (2) Jimdo Google Ads Terms of Service shall expressly become part of these Jimdo Google Ads Terms of Service.

    (4) Customer is responsible for providing the necessary notices and obtaining and maintaining all consents that may be required from its End Users and Site Visitors in order for Jimdo and Google to perform their respective contractual obligations. For this purpose, Jimdo will provide a sample text for the Customer's consent management (Cookie Banner Text) and a sample text for Customer’s privacy policy.  In addition, the customer is responsible for ensuring that all information he publishes and provides via Google Ads is correct, up-to-date and complete.

    (5) The Customer is prohibited from passing on or marketing Google Ads or individual modules or services thereof to third parties. 

    (6) Google may request information from the customer for the activation and use of Google Ads.

    Art. 3 - Violations of these Jimdo Google Ads Terms of Service 

    (1) Any breach of these Jimdo Google Ads Terms of Service by the Customer shall entitle Jimdo to refuse, suspend or terminate performance to the Customer and to terminate the contract without notice. 

    (2) The same applies to breaches of the terms and conditions referred to in Article 2 (2) Jimdo Google Ads Terms of Service which may be objected to by Google and which entitle Google to refuse, suspend or terminate performance to the Customer and to terminate the contract without notice.

    (3) The Customer shall indemnify Jimdo and its agents, officers, employees and affiliates against all claims arising from any breach under the provisions of Art. 3 (1) and (2) of these Jimdo Google Ads Terms of Service.

    Art. 4 - Warranty & Liability

    (1) Subject to the following provisions, Jimdo does not warrant the provision, quality, functionality, availability or support of Google Ads by Google.

    (2) Jimdo and its employees, representatives, agents and bodies shall only be liable in the event of intent and gross negligence or in the event of damage to life and limb, damage to health, or damage arising under the provisions of the Product Liability Act or breaches of cardinal obligations (obligations that are essential for achieving the purpose of the contract), whereby in the case of the latter liability shall be limited to the amount of the foreseeable damage typical for the contract. 

    Art. 5 - Miscellaneous

    (1) The availability and support of Google Ads services are governed by the Google Application Service Level Agreement ("SLA"). Questions may be submitted directly to Google via https://ads.google.com/intl/de_de/home/contact-us/. As far as questions regarding the integration of Google Ads in the Jimdo Dashboard are concerned, the Customer may contact the Jimdo support team. 

    (2) Jimdo and Google may amend these Jimdo Google Ads Terms of Service as well as the terms and conditions referred to in Article 2 (2) or the SLA referred to in Article 6 (1) from time to time without prior notice to Customer. The customer should therefore review these documents regularly. 

    (3) In all other respects, the general Jimdo Terms of Service shall apply.
