Art. 1 – General
(1) The following terms of use for connecting Google Ads to the Jimdo account (hereinafter the “Jimdo Google Ads Terms of Use”) apply where the Customer connects their Jimdo account to Google Ads via the Jimdo Dashboard.
(2) With the Google Ads service, you can connect your Jimdo account to Google Ads in order to create, manage, purchase and optimise your ads on Google Ads. Once the connection has been established, the data required for this purpose is transferred from your Jimdo account to Google. Creating targeted campaigns, defining audiences and viewing the associated statistics take place in your own Google Ads account with Google.
(3) Google Ads is operated and provided by Google Ireland Ltd, 4 Barrow St, Grand Canal Dock, Dublin 4, D04 V4X7, Ireland. Via the Jimdo Dashboard, Jimdo establishes the technical connection between the Customer’s Jimdo account and Google Ads and transfers the data required for the use of Google Ads to Google. With respect to the Google Ads service, Jimdo, Google and the Customer are independent contracting parties.
Art. 2 – Requirements and obligations of customers
(1) Consumers are excluded from connecting Google Ads. Connecting a Jimdo account to Google Ads and using Google Ads are reserved exclusively for business customers.
(2) The Customer may connect their Jimdo account to Google Ads and use Google Ads only if they agree to the following terms of Google and, for the duration of the contract, do not breach these or any other applicable laws and regulations:

- Google Ads Policies
(3) These terms under Art. 2 (2) of the Jimdo Google Ads Terms of Use are confirmed when the Customer connects their Jimdo account to Google Ads for the first time via the Jimdo Dashboard, by customers being expressly notified thereof. Google’s general terms and conditions pursuant to Art. 2 (2) of the Jimdo Google Ads Terms of Use expressly become part of these Jimdo Google Ads Terms of Use.
(4) The Customer is responsible for making the necessary disclosures and for obtaining and maintaining all consents required from their end users and website visitors so that Jimdo and Google can fulfil their respective contractual obligations. For this purpose, Jimdo provides the Customer with sample text for consent management (cookie banner text) and sample text for the Customer’s privacy policy. In addition, the Customer is responsible for ensuring that all information they publish and provide via Google Ads is correct, current and complete.
(5) The Customer is prohibited from passing on or marketing Google Ads, or individual modules or services thereof, to third parties.
(6) Google may require information from the Customer for the activation and use of Google Ads.
Art. 3 – Breaches of these Jimdo Google Ads Terms of Use
(1) Breaches of these Jimdo Google Ads Terms of Use by the Customer entitle Jimdo to refuse, suspend or terminate the service provided to the Customer and to terminate the contract without notice.
(2) The same applies to breaches of the terms referred to in Article 2 (2) of the Jimdo Google Ads Terms of Use that may be objected to by Google and that entitle Google to refuse, suspend or terminate the service provided to the Customer and to terminate the contract without notice.
(3) The Customer shall indemnify Jimdo and its representatives, officers, employees and affiliated companies against all claims arising from a breach by the Customer of the provisions in Art. 3 (1) and (2) of these Jimdo Google Ads Terms of Use.
Art. 4 – Warranty and liability
(1) Subject to the following provisions, Jimdo provides no warranty for the provision, quality, functionality, availability or support of Google Ads by Google.
(2) Jimdo and its employees, representatives, vicarious agents and bodies shall be liable only in the event of intent and gross negligence, or for damage arising from injury to life, body or health, for damage under the German Product Liability Act (Produkthaftungsgesetz), or for the breach of cardinal obligations (obligations that are essential for achieving the purpose of the contract), whereby in the latter case liability shall be limited in amount to the foreseeable damage typical for this type of contract.
Art. 5 – Miscellaneous
(1) The availability and support of the Google Ads services are governed by the Google Application Service Level Agreement (“SLA”). Questions can be addressed directly to Google via https://ads.google.com/intl/de_de/home/contact-us/. For questions regarding the connection of Google Ads to the Jimdo account, the Customer may contact the Jimdo support team.
(2) Jimdo and Google may amend these Jimdo Google Ads Terms of Use as well as the terms referred to in Article 2 (2) or the SLA referred to in Article 5 (1) from time to time without prior notice to the Customer. The Customer should therefore review these documents regularly.
(3) In all other respects, the general Jimdo Terms of Use apply.
